Having a baby with the help of sperm donors

Every fertility journey is different.

For single women, same-sex female couples, gender-diverse couples, or heterosexual couples experiencing male factor infertility, using donor sperm may be the only way of achieving their family dream.

The number of females using donor sperm has grown since the Victorian law changed in 2010, which enabled single females and same-sex female couples to access IVF in Victoria rather than travelling interstate.

At Create Fertility, we make the time to ensure you understand all the requirements and regulations associated with using donor sperm.

Types of sperm donors

We encourage you to take your time to consider all your options before choosing a donor that’s right for you.

Known donor

This is when the recipient knows the identity of their sperm donor. They can be acquaintances, family members, or friends who have agreed to donate sperm to help the recipient start a family.

Clinic-recruited donor

You may choose to use an unknown donor through our sperm donor program. Our sperm donors are assessed and tested thoroughly before being accepted into our program. Non-identifying information will be available (including information like their genetic makeup, hair and eye colour, medical history, hobbies, etc).

It’s important to note that identifying information about sperm donors, recipients and children created are registered on a Central Register maintained by the Department of Health. When a donor-conceived person turns 16 years old, they can request access to identify the donor from the Central Register.

Preparing to use known donor sperm

  1. You will go through a fertility health check, during which we’ll do some tests (including blood tests, saliva tests, and a pelvic exam).
  2. You’ll meet with one of our fertility specialists, who will go through your test results with you.
  3. If your fertility health check is okay, you’ll meet with our Donor Coordinator to discuss our program and the steps to choosing your sperm donor.
  4. Next, you will need to attend the required counselling appointments, and if you have a partner, they will need to attend also.
  5. You’ll have a follow-up appointment with one of our fertility specialists to go through the treatment and procedure.
  6. And finally, you’ll proceed with your fertility treatment, either IVF or IUI, in the hopes of creating a pregnancy.

Considerations to note before using donor sperm

Creating a family of your own may be your lifelong dream and the happiest moment of your life. However, there are still considerations that need to be taken into account.

Your partner

If you have a partner, it's crucial that they are included in the decision and understand the process and the aftereffects of using donor sperm. At Create Fertility, we require both you and your partner to attend counselling sessions. During this time, you both have the opportunity to discuss the ins and outs, ask questions and understand the long and short-term implications involved to ensure you both have a full appreciation of what it means to use a sperm donor.

Emotional considerations

The fertility journey can be an emotional rollercoaster. It's important to consider how using a sperm donor can affect you emotionally, as well as your partner and family. Some of these feelings include elation, gratitude, worry, and accomplishment. To finally be able to create a family of your own is a wonderful gift and a lifelong commitment.

Legal limits

In Victoria, there is a limit to the number of women who can use the sperm of each male donor, and this includes their own partner. Sperm from a single donor can be used by a maximum of 10 different women – 9 if they have a partner. This doesn't, however, limit the number of children that can be born using the same sperm and patient combination. This means that you could potentially use the same sperm donor for multiple pregnancies, creating biologically related siblings for your family.

Donor anonymity

When using a sperm donor with Create Fertility, information may be shared regarding the donor’s attributes, including hair and eye colour, nationality, hobbies, health, medical history, and lifestyle. No identifying information will be shared. By law, we must register information about sperm donors, recipients, and children with the Central Register maintained by the Department of Health. All donors must agree to have their identifying information released upon request from offspring when they turn 16 years old. If you are using a known sperm donor, we strongly suggest you seek independent legal advice in navigating expectations, boundaries, and the involvement of the donor and all other interested parties prior to proceeding with your donor.

Donors legal responsibilities

The donor has no legal responsibilities or rights to any child born through donor assistance. The woman giving birth is the legal mother of any child born. The recipient (individual or couple) is financially and legally responsible for the child and has full custodial and parental rights to the child. By law, we must register information about sperm donors, recipients, and children with the Central Register maintained by the Department of Health. All donors must agree to have their identifying information released upon request from offspring when they turn 16 years old. If you are using a known sperm donor, we strongly suggest you seek independent legal advice in navigating expectations, boundaries, and the involvement of the donor and all other interested parties prior to proceeding with your donor.

Donor payments

It's important to note that In Victoria, donating sperm is an altruistic act, and it is illegal to pay a donor to donate.
